Welcome to Ina J Photography. Please read these Terms and Conditions carefully before using our services. By accessing, purchasing, or participating in our photography services, programs, workshops, or online offers, you agree to these Terms and Conditions in full. If you do not agree, please refrain from using our services.
1. BUSINESS DETAILS

Services Provided: Pet photography sessions (including artwork design and delivery), photography coaching and business mentoring programs, live and recorded workshops, and free online training webinars.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Australia, specifically the laws of the New South Wales (NSW).
2. ELIGIBILITY AND ACCEPTANCE
By using our services or purchasing our products, you confirm that you are at least 18 years old and legally capable of entering binding contracts. If you are accessing our services on behalf of a company or organisation, you confirm that you have the authority to bind them to these Terms.
3. SERVICES AND PROGRAMS
a. Pet Photography: We provide consultations, photography sessions, professional editing, bespoke artwork design and delivery. Sessions may be subject to availability and seasonal scheduling.
b. Coaching and Mentoring: We provide structured business coaching programs, including workshops, accountability sessions, and personal mentoring. Participants must engage actively to benefit fully.
c. Workshops, Courses, and Webinars: Workshops may include live interactive sessions, recorded content, templates, bonus resources, and community access. Access conditions may vary and be time-limited.
4. BOOKINGS, PAYMENTS, AND FEES
a. Photography: A non-refundable booking fee (percentage of session fee or artwork minimum) is required to secure dates. Balances are due prior to the photography session or artwork delivery.
b. Coaching Programs: Coaching fees are payable upfront or via an agreed instalment plan. Missed payments may result in suspension of access.
c. Workshops/Blueprint Program: Enrolment fees vary by offer. Discounts, early-bird pricing, or payment plans may be offered.
d. Currency: All fees are stated in AUD unless otherwise specified.
e. Taxes: Applicable GST or VAT will apply where required under Australian law.
5. GEOGRAPHIC EXCLUSION
Ina J Photography’s workshops, courses, mentoring programs, and coaching services are not available to photographers based in Canberra, ACT, or within a 150 km radius of Canberra and its surrounding regions.
If a participant residing or operating within this exclusion zone purchases access or enrols without prior written approval, Ina J Photography reserves the right to cancel the enrolment and issue a full refund.
This policy protects existing client relationships, market integrity, and the exclusivity of the education provided.
6. REFUNDS AND GUARANTEES
a. Pet Photography: 100% satisfaction guarantee; if you are not satisfied, we will reshoot or refund session fees at our discretion. Artwork purchases are non-refundable once approved.
b. Marketing Workshop: Covered by our results-based guarantee. Participants who attend all three workshops live, complete the worksheets, and choose one campaign to run, if you don't see an increase in qualified enquiries or bookings within 30 days, send me your completed materials and proof of activity and show that you got no bookings or enquiries within 30 days of the final session and I'll refund your investment in full.
c. Free Webinar: As this is a free offer, no refunds apply, but attendees may retain bonus resources as specified.
d. Coaching Programs: Refunds available if clients fully participate, complete assigned tasks, and demonstrate no progress as outlined in the coaching guarantee. Refund claims must be made in writing within 14 days of completing the coaching program.
7. INTELLECTUAL PROPERTY RIGHTS
a. All photography content, artwork, templates, frameworks, webinars, and programs delivered by Ina J Photography are the exclusive intellectual property of Ina J Photography.
b. Clients may not reproduce, distribute, resell, or share materials without prior written consent.
c. Photography clients may use purchased artwork for personal, non-commercial use. Copyright remains with Ina J Photography.
d. Coaching clients may not duplicate program resources for other businesses or resale.
8. NON-COMPETE
Participants in coaching, mentoring, or educational programs may not use, replicate, or adapt Ina J Photography’s educational materials, strategies, or frameworks to offer similar coaching, workshops, or photography training programs for profit without prior written consent.
This includes offering competing education within Australia for a period of 12 months following completion of the program.
9. USER CONDUCT
You agree not to:
- Misuse or disrupt our services, websites, or communities (e.g. Facebook groups).
- Share login details, workshop links, or downloadable resources without permission.
- Harass, abuse, or disrespect other participants or team members in any setting.
- Infringe on intellectual property belonging to Ina J Photography.
10. DISCLAIMERS AND LIMITATIONS OF LIABILITY
a. We provide services, workshops, and coaching on an “as is” basis. We make no guarantees beyond those explicitly stated in our refund/guarantee policies.
b. While every effort is made to provide high-quality outcomes, results may vary based on user participation, market conditions, and personal engagement.
c. To the fullest extent permitted by law, Ina J Photography is not liable for lost profits, missed opportunities, loss of data, or indirect damages.
11. INDEMNIFICATION
You agree to indemnify and hold harmless Ina J Photography and its owner against all claims, damages, liabilities, and expenses arising from your misuse of the services, breach of these Terms, or infringement of intellectual property rights.
12. PRIVACY AND DATA PROTECTION
We collect and use personal data in accordance with our Privacy Policy. By engaging with our services, you consent to our use of your information for service delivery, marketing, and administrative purposes. Ina J Photography adheres to relevant data protection laws including GDPR (for EU clients) and the Australian Privacy Act.
13. TERMINATION AND SUSPENSION
We reserve the right to suspend or terminate access to workshops, communities, and coaching programs if you breach these Terms, fail to make payments, or engage in disruptive or harmful conduct. Termination does not entitle you to a refund unless otherwise specified in guarantee clauses.
12. DISPUTE RESOLUTION
a. In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation.
b. If unresolved, disputes shall be settled via mediation/arbitration conducted in NSW Australia, before escalation to court proceedings.
c. The governing law is that of the New South Wales.
14. MODIFICATIONS TO TERMS
Ina J Photography reserves the right to update these Terms at any time. Changes will be effective upon posting on our website or notifying registered clients. Continued use of our services indicates acceptance of updated Terms.
