1. Who these terms are between

1. 1."I", "me", "my" and "Ina J Photography" means Ina J Photography Pty Ltd, ABN 55 678 871 219, ACN 678 871 219, and anyone I engage to help run an Event. Correspondence about an Event goes to ina@inajphotography.com or to 14 Tooroonga Crescent, Jerrabomberra NSW 2619.
2. 2."Sony" means Sony Australia Limited, ABN 59 001 215 354, of Level 7, 73 Miller Street, North Sydney NSW 2060.
3. 3."Sony Scene" means the platform at scene.sonyanz.com, which Sony operates, not me. Where an Event is listed on Sony Scene, Sony is the platform and I am the Host.
4. 4. If you book through Sony Scene, the Scene Terms and Conditions apply to your use of Scene and to Sony's obligations to you, and these terms apply to the Event itself and to my obligations to you. Where the two disagree on something between you and me, these terms decide it. Nothing here limits your rights against Sony under the Scene Terms and Conditions.
5. 5.Where an Event is booked directly with me rather than through Sony Scene, these terms apply instead of the general Terms of Service and Terms and Conditions published on my website. Those general terms still cover everything else, including client photography sessions, gift certificates, giveaways and your use of the website itself.
6. 6."Event Fee" means the total price shown for the Event on Sony Scene or on my website, in Australian dollars and inclusive of GST.

2. What you are promising me

1. 7. By booking, you confirm that:
   • you are 18 or over and can enter a contract on these terms;
   • you have read the Event description and these terms; and
   • you are in good enough health and fitness to take part safely in what the Event description says the day involves.
2. 8. Under-18s are welcome at most Events, as long as a booked adult attends with them and stays responsible for them throughout. If you want to bring someone under 18, tell me before you book so I can confirm the Event suits them.
3. 9. If you are booking for someone else, you confirm that you are authorised to book for them, that you have given them these terms, and that everything in clause 7 is true of them.

3. Health, fitness and what the day actually involves

1. 10. My Events are built for adults of reasonable general fitness. What a given day asks of you depends on the Event. An outdoor Event may ask you to:
   • walk on bush tracks, beaches, paddocks or urban streets, usually between one and five kilometres;
   • move over uneven, muddy, sandy or unstable ground;
   • carry your own camera gear, water and food; and
   • stand or wait for long stretches, often in full sun or cold wind.
   Indoors or out, you should expect to kneel, crouch or lie down to shoot at a dog's eye level, and to be on your feet for much of the day.
2. 11. Whatever a particular Event involves will be in its description and in the detailed run sheet I send you beforehand. Read both. If something in there does not suit you, tell me before you book rather than after. If you are unsure whether you can take part safely, ask me ahead of time.
3. 12. You can opt out of any activity at any time, for any reason, without needing to explain yourself to me. Opting out of part of a day does not entitle you to a refund of any part of the Event Fee.
4. 13. As a condition of booking, you must tell me about any medical or physical condition that could put you or anyone else at risk, or that I would need to know about in an emergency. I will keep that to myself. I do not take on responsibility for your medical care.
5. 14. I strongly recommend you hold your own insurance covering personal injury and damage to your equipment for the duration of the Event, and travel insurance as well for any Event involving travel or an overnight stay. My insurance does not cover your gear or your injuries.
6. 15. Costs you incur that are not expressly included in the Event Fee, such as parking, entry fees, fuel, meals or accommodation, are yours. I will tell you in the Event description and run sheet what is and is not included.

4. The dogs

1. 16. The dogs at my Events are model dogs I arrange, and they come with their own handlers. Dogs are the point of the day and also the least predictable part of it, so:
   • Only the handler directs their dog. Do not touch, feed, call or move a model dog without asking the handler first. If you want the dog to do something, ask.
   • Please do not bring your own dog unless the Event description says you can. The dogs are booked, briefed and matched to the number of people in the room, and an extra dog changes that for everyone.
   • Dogs are not props. If a model dog is unsettled, tired, or simply not up for it, I will rest it, swap it, or change the plan. That is part of photographing animals rather than a fault in the day, and it is not grounds for a refund.
2. 17. Some outdoor locations require dogs to stay on lead, for the sake of local wildlife or under the rules of the reserve or property we are on. Where that applies I will tell you in the run sheet, and it is not negotiable on the day.

5. Confirming your booking

1. 18. These terms become binding on both of us when your booking is confirmed.
2. 19. Your booking is confirmed when you have received a confirmation email from Sony Scene or from me, and the payment required to secure your place has been received.
3. 20. Places are limited and are allocated in the order payments come in. A place held while payment is pending is not a confirmed booking.
4. 21. Some Events require you to sign a release and indemnity form before you take part. Where that applies I will say so in the Event description and send you the form in advance, so you can read it before the day rather than on it.

6. Paying for your place

1. 22.Most Events are paid in full at the time of booking. Where that is the case, there is no deposit and no balance to follow.
2. 23.Multi-day retreats are the exception. A deposit of 30% of the Event Fee secures your place, and the balance is due 60 days before the retreat starts. Where a particular retreat works differently, its Event description will say so and that description governs.
3. 24. Deposits are non-refundable, except where clause 30 or clause 32 applies.
4. 25. If a balance is not paid by its due date, I may cancel your booking and keep the deposit. I will send you a reminder before the date, and I will contact you again before I cancel anything. Nobody loses a place without hearing from me twice.
5. 26. If you book after the balance due date has already passed, the full Event Fee is due to secure your place.
6. 27. I take care with prices, but errors happen, and on Sony Scene I can only publish a correction once Sony approves it, which can take time. If a price is listed incorrectly I will tell you as soon as I know, and you can either pay the correct price or cancel and have everything you have already paid refunded in full.
7. 28. Very occasionally an Event Fee has to rise after your booking is confirmed, because a third-party supplier has raised their price or something else outside my control has shifted. I will tell you as soon as I can, and clause 30 sets out when that entitles you to walk away.

7. Cancelling and refunds

1. 29. Cancellations must be in writing, by the person who made the original booking, to ina@inajphotography.com. The date of cancellation is the date I receive that written notice. If you booked through Sony Scene, please copy Sony in, because Sony processes the payment.
2. 30.You may cancel with no penalty at all if any of these is true:
   • you are entitled to cancel under the Australian Consumer Law;
   • you tell me 90 days or more before the Event start date;
   • the Event Fee has risen by more than 10% under clause 28; or
   • there has been a major change to the Event before it starts, meaning a change to the dates, a reduction in the number of days, or a change to the main locations in the itinerary.
3. 31. A change of accommodation, or a small change to the programmed activities, is not a major change for the purposes of clause 30.
4. 32.Every Event needs a minimum number of confirmed bookings to run, and for most Events that number is six. I decide whether the number has been met 14 days before the Event. If it has not, I cancel the Event and refund everything you have paid, deposits included. Where a particular Event uses a different minimum or a different decision date, its Event description will say so.
5. 33.Events booked through Sony Scene follow Sony's cancellation window, which is 14 days. Cancel more than 14 days before the Event and you are refunded. Cancel inside 14 days and you are not. Sony processes the payment, so Sony processes the refund. Where the Event listing on Sony Scene sets out a different window, the listing governs.
6. 34.For Events booked directly with me, the ladder below applies if you cancel outside the circumstances in clause 30. Which half you are on depends on the total Event Fee.

1. 35. Where an Event was paid in full at booking and no deposit applies, "the balance" in the table above means the whole Event Fee.
2. 36.Transferring your place. For single-day Events booked through Sony Scene, your ticket is valid for whoever holds the confirmation email, so you may pass your place to someone else. Please tell me who is coming instead, because I brief the model dogs and write the run sheet around the people I am expecting. Multi-day Events and retreats booked through Sony Scene are non-transferable, which is Sony's rule rather than mine. For Events booked directly with me, ask and I will usually say yes if you find someone suitable and tell me in time.

8. If I have to change or cancel an Event

1. 37. If I cancel an Event outright, for any reason other than a Force Majeure under section 11, you choose: a full refund of everything you have paid, or a transfer of the full value to another Event.
2. 38. If I have to postpone an Event, I will offer you the new date. If the new date does not work for you, you may take a full-value credit against another Event within 12 months, or a refund of everything you have paid.

9. Photographs, yours and mine

1. 39.You own the copyright in the photographs you take at an Event. That does not change. The copyright terms on my Terms and Conditions page cover images I make of your pet at a client photography session. They do not apply to images you make yourself at an Event.
2. 40. You may use the images you make of my model dogs in your own portfolio, on your website, and on your social media, with a credit to the Event. You may not sell them, license them, submit them to a stock library, or enter them in a competition, without the handler's written permission and mine.
3. 41.You are welcome to post your Event images to the Sony Scene Community Gallery. My model dog handlers have signed releases covering participant posting and Sony's promotional use, so that base is covered. Be aware that posting there grants Sony a licence to use the image to promote Scene, which is set out in the Scene Terms and Conditions.
4. 42. I photograph and film at my own Events, and you may appear in that material. By booking, you agree that I may use those images and that footage to promote Ina J Photography and future Events. Sony may separately use your likeness to promote Scene under the Scene Terms and Conditions, which is Sony's arrangement with you, not mine. If you would rather not appear in my material, tell me at the start of the day and I will work around you. No explanation needed and no hard feelings.
5. 43. Please do not photograph another participant close-up, or post an image of them, without asking them first.

10. Risk, injury and your gear

1. 44.Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. My services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure with a service you are entitled to cancel and to a refund for the unused portion, or to compensation for its reduced value. Everything in this section and in section 11 applies only so far as the law allows.
2. 45. Where an Event runs outdoors, you acknowledge that natural environments carry dangers that are obvious and inherent, including uneven or unstable ground, rocks, water, mud, wind, dust, heat, cold, rain, slippery surfaces, insects and wildlife. Indoors and out, you acknowledge the ordinary unpredictability of animals. Any of those can cause injury or damage property.
3. 46. For the duration of the Event you take responsibility for:
   • your own health, safety and wellbeing;
   • taking reasonable care to avoid the dangers in clause 45;
   • any injury you suffer, and any injury you cause to someone else; and
   • loss of, theft of, or damage to your own equipment and belongings.
4. 47. So far as the law allows, you release me from any claim arising out of the matters in clauses 45 and 46, and my liability for any claim connected with an Event will not exceed the Event Fee you paid for it.

11. Weather, and things outside anyone's control

1. 48. Where an Event runs outdoors, the weather does what it likes. Where heavy rain, extreme heat, high fire danger, poor air quality from smoke, or a severe weather warning makes an Event unsafe or unworkable, I will decide whether to cancel or postpone 24 to 48 hours beforehand, unless something extraordinary forces a later call.
2. 49. An outdoor Event may still go ahead in ordinary bad weather. Cloud, cold and light rain are shooting conditions, not cancellation conditions. The run sheet will tell you what to wear and bring.
3. 50. Cancellations and postponements are communicated by email, by phone, and through Sony Scene's messaging where the booking came through Sony Scene. Make sure the contact details on your booking are ones you actually check.
4. 51.Force Majeure means something extreme and outside my control that makes an Event impossible or unsafe to run, including fire, flood, storm, natural disaster, epidemic or pandemic, public health orders, war, civil disturbance, terrorism, industrial action, serious illness, and the failure of transport or access routes.
5. 52. Where a Force Majeure stops an Event from starting or continuing, I will refund you for the part of the Event not delivered, less any costs I cannot recover from third parties and a reasonable administration cost. Beyond that, and so far as the law allows, I am not liable for your other expenses, including travel, accommodation and time off work.

12. Conduct

1. 53. By booking you take responsibility for how you behave at the Event, toward me, the other participants, the dogs and their handlers, venue staff, and the public.
2. 54. I may end your participation immediately, at any point, if I consider your conduct:
   • has caused or is likely to cause injury to any person or animal;
   • has caused or is likely to cause damage to anyone's property;
   • threatens the safety or wellbeing of anyone present; or
   • is repeatedly disruptive, including persistent lateness to call times.
3. 55. If I end your participation under clause 54, no refund is due and I am not responsible for your costs in getting yourself home or finding alternative accommodation.
4. 56. If your conduct causes injury or damage to property, you indemnify me against any claim a third party brings against me because of it, so far as the law allows.

13. Your information

1. 57. I collect your contact details, emergency contact and any health information you give me only to run the Event safely, and I do not sell or share them beyond what running the Event requires. My Privacy Policy covers the rest. Where you booked through Sony Scene, Sony collects your information first and passes what it needs to me as the Host, under Sony's own privacy policy, which I do not control.

14. General

1. 58. These terms are governed by the law applying in New South Wales, Australia, and both of us submit to the courts of New South Wales.
2. 59. If any clause turns out to be unenforceable, it is severed and the rest of the terms keep working.
3. 60. The terms in force are the ones published on this page at the time you book. I may update this page for future bookings.
4. 61. Questions go to ina@inajphotography.com. Ask before you book, not after.
